What Is a “Wrongful” Death?

In Pennsylvania, a wrongful death is one that is “caused by the wrongful act or neglect or unlawful violence or negligence of another.” A wrongful death lawsuit is a civil action, as opposed to a criminal case. Regardless of whether or not the person or party responsible for the death faces criminal homicide charges, and regardless of the outcome of criminal proceedings that do occur, they may be the subject of a civil wrongful death lawsuit if the plaintiff can prove that they were more likely than not to have caused the death.

How Long Do You Have to File a Wrongful Death Lawsuit in Pennsylvania?

The statute of limitations on wrongful death lawsuits in Pennsylvania is two years from the date of death. This means that you have just two years to bring your lawsuit; if the statute of limitations expires, the court will almost certainly dismiss your case.

It should be noted that, in Pennsylvania, only the personal representative of the decedent’s estate may file a wrongful death lawsuit. This is someone who has either been named in the decedent’s will or, if the individual died without a will, someone appointed by the court. Often, but not always, the personal representative is a close family member of the decedent, such as a surviving spouse or child.

The purpose of filing a wrongful death claim is to seek monetary recovery for certain economic and non-economic losses suffered by the decedent, the decedent’s estate, and/or the decedent’s eligible surviving family members.
