Road Defects
The Department of Transportation and local municipalities have a duty to provide a safe roadway for the traveling public. In so doing, they are required to follow design criteria and maintenance manuals established by entity responsible for the roadway. Examples of negligent design and maintenance include the failure to properly place traffic signs at an intersection; the failure to properly maintain the roadway, which includes the berm of the road; and the failure to prevent obstructions within the traveled portion of the roadway.
When the Department of Transportation and local municipalities fail to design and adequately maintain roadways, motorists are at an increased risk of an accident occuring. Accidents in road defect cases often lead to devestating injuries.
In pursuing these claims on behalf of the injured party, there are times the the law firm will need to hire experts with backgrounds which will allow them to render an opinion concerning the alleged road defect. In addition, accident reconstruction experts may also need to be retained to establish that the road defect was the cause of the accident.
