Pennsylvania considers it a primary offense for drivers to use handheld wireless phones, smartphones, computers, and other Interactive Wireless Communication Devices while operating a vehicle, even when stopped at a light or in traffic. A violation carries a $50 fine along with court costs and fees. The law also prohibits making or receiving phone calls if the device is held in hand, although hands-free use and emergency calls are allowed.

In 2023, the National Highway Traffic Safety Administration reports that 3,275 people were killed in motor vehicle crashes involving distracted drivers, a small decrease from 3,315 in 2022

Understanding Pennsylvania’s Distracted Driving Laws

Currently, it is illegal for drivers to send, read, or write text messages while a vehicle is in motion. This includes using cell phones, smartphones, or other devices capable of messaging, emailing, or internet use. GPS devices and systems integrated into the vehicle are not covered under this ban. Violations carry a $50 fine, plus court costs and fees, though non-commercial drivers do not receive points on their record.

As of June 5, 2025, Pennsylvania’s new hands-free law, known as Paul Miller’s Law, is in effect. This law makes it a primary offense to hold or use a handheld device while driving, meaning police can stop a driver solely for this violation. For the first year, offenders will receive warnings. Starting June 5, 2026, penalties will include a $50 fine. In serious cases, such as distracted driving that leads to a fatal crash, drivers may face additional prison time.

The law does allow exceptions for emergency use, such as contacting law enforcement or emergency services. Drivers may also use devices if the vehicle is pulled safely to the side of the road. The goal of these laws is to reduce distractions and make Pennsylvania’s roads safer for everyone.
