What Is the Statute of Limitations on Personal Injury Cases?

Like every other state, Pennsylvania has a statute of limitations when it comes to filing personal injury lawsuits. This means that you have a limited amount of time to file your lawsuit; if the statute of limitations expires, your case will likely be dismissed, and you will lose your right to sue for damages.

In Pennsylvania, the following statutes of limitations apply:

  • Two years from the date of injury when the injury was immediately discoverable
  • Two years from the date on which the injury was discovered or reasonably should have been discovered when the injury was not immediately discoverable
  • Two years from the date of death in wrongful death cases

Some exceptions may apply, for example, in cases involving child injuries and claims against government officials and/or agencies. Is Pennsylvania a No-Fault Car Insurance State?

Pennsylvania is one of several states to follow a no-fault car insurance system. Under this system, anyone who drives a passenger vehicle in the state must carry no-fault, or personal injury protection (PIP), insurance. After an accident, injured drivers and vehicle passengers can file PIP claims with their own auto insurance providers and receive compensation for certain covered losses.

Unfortunately, PIP insurance does not cover any non-economic damages resulting from a crash, such as pain and suffering. Due to its relatively low limits, it is also often insufficient to cover the full extent of an accident victim’s economic damages, including medical expenses and lost wages. When this is the case, eligible individuals may be able to go outside the no-fault system and bring a third-party claim against the at-fault driver’s insurance company and/or sue the at-fault driver directly for damages. There are certain requirements you must meet to do this, including proving that your injuries meet the state’s “serious injury” threshold.
