Punitive Damages in a Medical Malpractice Lawsuit

Going to the doctor can be scary for some people in Pennsylvania. This is generally because they are afraid they will find out that something is seriously wrong with them. However, most people still go to the doctor because they also know that they need the doctor to treat the illness or injury so eventually they will feel better. However, sometimes people leave the doctor feeling worse than when they first arrived. This could be because of unforeseen complications, but it could also be because the doctor made a mistake.

Almost any procedure, even simple ones, have complications associated with them that are out of any doctor’s control. However, doctors are also human and their mistakes can make a current problem worse or create a new problem. These damages usually are for the financial consequences such as additional medical bills or lost income, but can also include compensation for pain and suffering and even punitive damages.

Punitive damages are additional payments the doctor must make as a way to punish them for their actions. Therefore, punitive damages are not available in every medical malpractice lawsuit. They are limited to just those cases when the doctor acted willfully or with reckless indifference in their actions which caused the harm to the patient. These types of damages also differ from the other forms of compensation because they are capped at twice as much as the compensatory damages award.

People in Pennsylvania go to the doctor for many different reasons every day. For the most part they leave at worse in the same position they were in when they got there. However, from time to time they leave in a worse position and sometimes this is due to mistakes made by the doctor.
